The United States Congress included in the 2018 Omnibus bill a renewed exemption for farmers from the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). CERCLA requires private entities and individuals to report instances of releasing hazardous substances to the EPA, and the exemption for farmers was challenged in court in 2017. Congressman Andy Harris, M.D. (MD-01) – a cosponsor of the Agricultural Certainty for Reporting Emissions Act – issued the following statement in support of this exemption:
“While the 2018 omnibus was a deeply flawed bill, I applaud the inclusion of a renewed exemption for farmers from the burdensome regulations of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). Restoring this exemption protects farmers from the reporting requirements imposed on larger entities that release hazardous substances in significant quantities. As a cosponsor of the bipartisan Agricultural Certainty for Reporting Emissions Act, I recognize that the farmers in Maryland’s First District should be allowed to focus on their work instead of jumping through bureaucratic hoops.”

I’d love to know the stats where you came up with that?
I have several acres of property in Harford County and literally, every day I can walk the road and pick up all the refuse thrown out the window of cars.
Refuse to include, beer bottles,, cigarettes, fast food bags, and various other food/paper products that have become trash.
I pick it all up in the evening, then by the following day there it is all over again.
Maybe it’s the same person doing it? Maybe we need laws about littering?

That’s a good question, as I leave my residence and drive down the road on either directions there’s the same amount of refuse on the shoulder of the road, both sides, both directions.
If people are throwing trash out their window because they despise me, they sure are shitting on other people’s property way fvckin’ down the road as far as I can drive.

These laws were trying to regulate the smells from manure and the dust from crop harvesting. The obama EPA was trying to regulate farmers “cow farts” the same as industrial pollution. The only thing that congress did was to use some common sense and realize that farmers are already regulated enough. You enjoy cheaper food and more abundant supply of food than anybody in the world. Also, I believe the trash you throw out of your cars, especially plastic bags and aluminum cans are “bane” of civilization. Our cows end up eating it, and it fouls our farm equipment, and it ends up in the bay and oceans.

I’m normally against regulation and believe we are over-regulated. However, when it comes to the environment, I do believe the human thing to do is to preserve and conserve for those who come after me. If the regulations were in fact directed at the smell of manure, dust from crop harvesting and the passing of gas of the cows in the pasture, then I’m with Harris on this repeal. But, we all know that is not the real measure of these regulations and it’s shameful to allow a farmer to release a pollutant into the environment when an average everyday person gets fined for the same offense. The run off of fields using manure contaminates the bay with the byproducts of the manure contained in the run off. Is it the dust from harvesting or is it the dust from insecticide while crop dusting? Is it really about cow flatulence? It doesn’t matter now, the regulations are repealed and if a community starts getting cancer of poisoning from contaminated water you have only one person to thank. Andy Harris…..
