From the office of Del. Pat McDonough:
President Obama’s lawsuit against Arizona is directed at the wrong state. The allegation that Arizona’s new immigration law is in conflict with federal authorities is completely wrong. The Supreme Court and other federal Appellate courts have ruled consistently that unless state law actually conflicts with federal law, there is no preemption. The Arizona Law simply duplicates the Federal Immigration Act and provides the state with the authority to enforce its tenets. There is no conflict.
However, there is one state among many that creates policies conflicting with federal law. Maryland’s Governor and other politicians continuously impose policies that violate the Federal Immigration Act by aiding and abetting illegal aliens. These misguided actions are known as “sanctuary policies.” The Governor, Baltimore’s Mayor, and General Assembly leaders have been reliable friends of illegal aliens and their professional advocates.
The Federal Immigration Act, in forceful language, prohibits “aiding and abetting” anyone who is here illegally. The most glaring example is the Maryland’s driver’s license system. The “lawmakers who support lawbreakers” that control the General Assembly, along with Mr. O’Malley, passed an amnesty bill last year permitting illegals to continue to have driver’s licenses. This same group of so-called leaders has pumped millions of taxpayers’ dollars into the illegal alien advocacy group known as “Casa de Maryland.” Some of that taxpayer funding helped purchase and revitalize a multi-million dollar mansion to be used as Casa de Maryland’s headquarters.
In Baltimore City, Mayor Rawlings-Blake has continued the “sanctuary policy” of former mayors O’Malley and Dixon. The current city’s chief executive helps to fund day labor centers that assist illegals and mandate that local police may not enforce the Federal Immigration Act. The height of hypocrisy becomes full-blown when it is publicized that Mayor Rawlings-Blake will join as a partner in the lawsuit against Arizona when it is clear she is the one violating federal law.
The saddest part of this tale of dangerous politicians in our state is the consequences they are causing to ordinary citizens. For example, in Baltimore City, crime and drugs are destroying its life blood. 80% of the drugs that help conduct chemical warfare against Baltimore and surrounding areas come across the Mexican border. The gang and drug kingpins who manage this violent system come across the Mexican border. The minority unskilled youth in Baltimore City that suffer from 65% unemployment are having their jobs displaced by unskilled illegals. The black and white working families struggling to educate their children are being forced to spend millions of dollars of their hard-earned money to pay for educational and healthcare benefits for illegals.
As a result of these dangerous policies imposed upon us by reckless politicians, more than 350,000 illegals have invaded our state, costing us approximately 2 billion dollars annually. The Governor, Mayor, and General Assembly leaders are the problem, not the solution. Their hard-core “sanctuary” policies are vigorous violations of federal law. Yes, President Obama, Maryland’s citizens and legal immigrants are hopefully waiting for you to be overcome by honesty and launch a much needed lawsuit against America’s number one “sanctuary” state.

I’ve lived in and around Baltimore city most of my life. From nice suburban places to some of the worst areas in the city. While immigration isn’t our only problem this article is right on.
Laura says
How will the Federal Government suing Maryland help solve any of our problems?
It is incredibly short sighted to say that funding CASA de MD is “aiding and abetting” illegals. We cannot lose sight of the the fact that CASA provides job training for those here legally as well as language education courses. There is a lot of good that is done by those organizations.
I am sure that Del. McDonough would just prefer an irradication of all hispanics- whether they are here legally or not- I only wish he would focus his attention on the issues that actually threaten this State; like our budget shortfall, joblessness and healthcare.
Rob in Bel Air says
Have you given any thought to the fact that perhaps illegal immigration could be part of Maryland’s budget woes? How much do you think is paid out for medical care to persons who are here illegally? How many jobs are taken away from US citizens by perple here illegally?
ForestHillResident says
There he goes again ranting against the sweat shop workers who made his Toupee. Please someone explain to him that if he doesn’t like it he doesn’t have to wear it.

That’s a little much, don’t you think?…a personal attack, when the Delegate is discussing a very serious topic that is costing young people their lives (the drug trade) and taxpayers millions of dollars. You should be ashamed of yourself.
Rob in Bel Air says
After reading some of the posts here, I see many still do not get it. I’m just not sure what it will take to explain the word illegal. The law is the law and it is illegal for one to enter this country w/o going through the proper procedures. Why is that so hard to understand? O’Malley and friends do not support these so-called “New Americans” out of the goodness of their hearts … it is a large voting block that helps democrats stay in power in this state. It is Maryland tax dollars which goes to oganizations such as Casa de Maryland and then returned in the form of donations to democrats.
Yes, O’Malley the the rest of the bunch in Annapolis (and Baltimore City) are violating federal law; yet nothing will be done about it.
Those who dislike Delegate McDonough or what he said in his statement need a CIVICS lesson. Moreover, it would not surprise me if the negative posters here are they themselves in this country illegally, and/or have family in this country illegally, and/or have friends in this country who are here illegally.
You can’t have it both ways: you can’t say, OK, we will enforce this law but not that one. For example, many here want to turn a blind eye to those who break the law by entering this country illegally and draw money from the public dole (welfare, education, etc), yet enforce a law for welfare fraud or theft. You just can’t have it both ways … sorry. Has any of the “do-gooders” here looked into how Mexico treats persons entering its country illegally?
With all that said, I will be the first to admit that mnay of these people who illegally cross our border come here to work and they do work hard. But many also cross the border for the purposes of receiving social benefits and that is taking our hospitals, our social institutions and this country broke (many are laughing all the way to the bank – or while they are on their way back to their home country).
Rob in Bel Air says
Now you are being nasty. If you don’t have anything constructive to say . . . bug off ! ! !
ForestHillResident says
This article is absolutely not a knowledgeable opinion of someone licensed to practice law but rather a shameless stump speech of an ineffectual candidate that has to stir up Xenophobia by download his ideas off racist listserves to mask the fact that he’s done absolutely nothing in office beyond cashing his paychecks.
Why did the dagger not put this tripe in TheDirt where it belongs? Why doesn’t McDonough free airtime count as a campaign contribution?
It’s clear that both McDonough and Impallaria both play fast and loose with rules and laws to suit their own agenda. Let’s not forget them trying to take over the Harford County delegation a couple years ago because again they saw themselves above the rules that normal people follow. McDonough can’t even follow the simple rules of a 4th of July parade without incident. Baltimore and Harford County can certainly do better than this toxic duo.
Phil Dirt says
Empty talk. What did your diatribe have to do with the issues mentioned in his letter? Why don’t you refute his points instead, especially the sanctuary policies?
ForestHillResident says
Maryland State Bar Association has a web page I remember reading that I think best sums up McDonough’s above spewtum:
“To protect people, the law provides that only lawyers may give legal advice. A non-lawyer may not give legal advice even impartially trained in a specific area of the law. A lawyer’s license to practice is granted by the state’s highest court, the Court of Appeals of Maryland. It is your assurance that the lawyer has met the standards required for admission to practice law and is qualified to properly represent you in legal matters. A member of the Maryland Bar, a lawyer is required to follow a professional code of conduct and urged to stay current on changing laws through continuing legal education. A lawyer is most importantly an officer of the court, authorized to explain and interpret the law for you and represent your interest both in and out of court.” http://www.msba.org/departments/commpubl/publications/brochures/lawyer.htm
If McDonough is going to publish these legislative opinion pieces (this is what, the 3rd one now?) he should at least make clear that he is not a member of the bar. His legislative bio claiming his attendance of 2 different local colleges leaves me with the impression he was to dense to gain even an undergraduate degree. My bottom line is that no 2-time college drop-out is well enough researched or versed on the subject for me to view him as a trusted advisor much less the State’s standard-bearer on this topic.
Put another way, it doesn’t matter what he says here because he is simply incapable of accomplishing anything on this front legislatively that doesn’t end up costing Maryland taxpayers tens of millions in legal fees defending such nonsensical policies and likely hundreds of millions in summary judgments for resulting civil rights violations.
This is a no-win money-loosing budgetary-sinkhole boondoggle that every self-respecting penny-pinching tea-party conservative really should have enough analytical common-sense to avoid bringing here.
The dagger looses credibility whenever they treat this crap as news rather than a morally bankrupt politician campaigning to tie-up the local racist/xenophobe vote (yours?) because no one else believes in this clown and clearly he knows it.
Jessica says
ForestHillResident I would like to high-5 you! I absolutely despise McDonough and I was thrilled when he didn’t participate in the 4th of July parade this year! I didn’t even have to write another letter to the parade committee! I know where I would like to shove one of his Speak English signs.

Why don’t the lawmakers crack down on the business people who hire illegal immigrants? Oh, wait, I know the answer.
Stop the jobs; stop illegal immigration. Of course, that would cut down on political contributions and the politicians couldn’t have that.
Cdev says

Fed Up says
That is a farce – the Federal Gov. is responsible for our borders, not every single citizen (I’m guessing you don’t like what Arizona is doing, right?). I believe it is absolutely reasonable here in MD or any other State to assume that a guy looking for a job, some 2000 miles from the Mexico border, is here legally. If not, who has failed us? Please check the definitions of “legal” and “illegal”. Most of us would agree that NOBODY can selectively pick which laws they wish to obey or disobey!
thinking of a new name says
So many folks really are clueless. This guy seems like a doofus to me, but his anti-illegal message is spot on. Unlike so many, I have dealt with INS (now ICE) and the state department and they are a juggernaut of incompetence, apathy and waste. You could fire half of them and never notice the difference – except maybe a slight increase in efficiency. For every illegal in this country there are thousands that would like to come here legally as an immigrant or tourist and are routinely denied. Of course to receive that denial costs over $100 US (non-refundable) paid to the US consulate (bet ya didn’t know that). No wonder ambassadorships are given out as favors to the sleezy friends of dirtbag politicians since they must be quite lucrative. These are English speaking, skilled workers and money spending tourists denied entry while the southern border hemorrhages illegal non-English speaking unskilled laborers. Every illegal here is a criminal knowingly breaking the law and as someone who has gone through the process of getting a spouse a green card and citizenship legally I deeply resent those who are here illegally. Who the hell do they think they are and where did all these idiots come from that want to defend their flaunting of the law?
Of course on the ironic side, for every thousand bleeding hearts that want to protest for illegals’ rights there’s a fat cat sitting on his pile of money from hiring illegals laughing his butt off at (and thanking) them.

What is wrong with some of the Legislators in Maryland? Illegal aliens don’t understand the meaning of the word “ILLEGAL” and it appears the Legislatores don’t eithere.
Illegal aliens are destroying this Country, and one would have to be almost blind not to see this. How much longer do we have to support these illegal aliens? How much longer do we have to school their illegal alien children? How much longer are we going to let them have our jobs? How much longer are we going to put up with all the crime, stolen identities, forged documents, fake green cards? How much longer are we going to allow these illegal aliens to send money out of this Country and bring our Country down? Oh, amnesty will correct all this. WRONG! Nothing will change except we wouldn’t be able to call them illegal aliens any more. Let’s get rid of these illegal aliens! Let’s get them back to their own Country where they belong!

Is the guy who shot the other guy at the American Legion in Bel Air responsible for any of the things you describe? Is the motorcycle thief in Edgewood? Should we not go after them since the crashing economy is not their fault and they didn’t cause the oil spill?
I think FHR should voluntarily double the amount of taxes he pays from this point forward and dedicate it to the illegals that he speaks so fondly of since I don’t want a cent to go to them.
Here’s one for you. Have you ever heard of doing more than one thing at a time? (The grownup word for that is multitasking. Look it up.) It is possible to handle multiple situations at the same time. Really, it is. I’m 90% certain.

No McDirt –
Rakin Muhammad, aka “Black”, age 20, of Parkville, MD, who allegedly murdered Derrick Maxey Jr., 25, of Aberdeen is not responsible for anything I listed, nor is he an illegal immigrant. Same goes for 23-year-old Timothy Patrick William Jr., who is allegedly responsible the theft of the Motorcycle in Edgewood. I’m not sure what you were attempting. I’m guessing you were speaking in code trying to clarify that you’re brand of klan is equally aligned against muslims, blacks and the poor but need this anti-immigration tar-baby to get passed so that it’s easier to also take away their civil rights?
Let’s be clear that our excellent police force in Harford county were successful in solving both of these crimes without violating anyone’s civil liberties in the process.
There is no way that I’m going to let bottom-feeding money-grubbing scum-bags like you start frivolously suing law enforcement officers for not systematically detaining people with brown skin, strange last names and/or accents when they can’t produce thier id. This proposal will absolutely not make streets safer or the the job of law enforcement and the courts any easier. I stand with them in opposition of you.
Phil Dirt says
What is wrong with you? You post a list of problems and state that illegal immigrants are not responsible for them so we shouldn’t worry about them (the illegals) and concentrate on the problems. I reply that thos two dudes aren’t responsible for the things you list either, but smart people can multitask and deal with several unrelated issues.
So how does this turn into “Phil hates Muslims and blacks” and “Phil is frivolously suing law enforcement officers”? Where did I ever say that? Are you that delusional? You seriously need help.

FHR, Let me get this right… so even though I’ve been through the process with my spouse – green card and citizenship via fees, forms, fees, fingerprints, (oh, no the police can’t do that WE have to… just pop by our Dover office…), fees, and more forms – all legally, even then… if I resent someone that comes here illegally and knowingly by their very presence here is breaking the law… I’m a racist. Ha ha. Funny. That’s why I married a foreigner… ‘cause I’m a racist. Oh stop, my sides…
Have YOU dealt with INS/ICE? The State department? After you jump through their hoops and pay through the nose come back and tell me how the whole world has the right to come here illegally. Going through the process is also why I know legal residents are required to carry the card. Why do you suppose the feds tell them to carry the card at all times?
We have lots of friends and relatives who can’t come here because the Fed’s deny them a Visa – repeatedly… I’ve given up since its 120 bucks a pop… while millions of illegals waltz the streets here with the blessings of so many like yourself – making it even harder for me to get someone here legally. But if I resent that I’m a racist. Of course, if I was “Someone” I wouldn’t have these problems. I could pull strings… THAT seems fair. Charlie Rangel could probably skip the whole green card thing and get Beelzebub citizenship and a lifetime federal judge spot.
The whole racist thing is a crock. It’s a way to write off any opposition to illegals. The simple fact is they are knowingly breaking the law and that makes them criminals.
And you’re right, our excellent police force apprehended the bad guys… has our crappy justice system released them yet? No? They’ve released them so many times before that it should be any minute now… after all, they can’t be hanging around the court house all day, there’s a back nine waiting out there.
See? I made my point and I never insulted you once.
Cheers.

If you’re saying we need the immigration bill to improve citizen safety in Maryland, I don’t know how you can make that claim without at least one racially derogatory statement. Phil Dirt’s attempt at insinuating that local crimes were immigration related triggering my tirade that forcing him to back down and say that really wasn’t what he meant as a means of damage control is nothing that I see the need to apologize for.
How upset would you be if during all that process of dealing with the federal government, she was thrown in local prison a few times until you could come get her for not carrying all the proper paperwork at that time?
How upset would you be if that then becomes a documented issue of not carrying proper paperwork that then makes the federal process 10 times harder as they try to sift through “pending local issues”?
Why are you so hard-hearted that you would wish a worse experience on others than what you had to suffer through?
McDonough’s plan is to introduce a bill that makes all different people in this country guilty of illegal immigration until proven innocent. If local law enforcement doesn’t take this approach, they WILL be sued by some handful of racist money-grubbing SOB’s and their lawyers — if for nothing else than a whorish attempt at a press release in an election year like Imparallia did vs a hs drama club outside his district.
I do not think everyone is in that group and I applaud you for not thinking like such a person. Still, don’t get fooled into thinking this proposed bill is rational or that McDonough or Imparallia are representatives that we can allow to remain in office.
Phil Dirt says
ForestHillResident, I await your apology for this latest example of your derogatory and incorrect postings.
Stop dragging my name into your pathetic attempts at making your point. I did not “back down” on anything since I did not make any such posts, and your inability to distinguish between individual posters gives the impression that you have lost your grip on reality.
thinking of a new name says
FHR, as for your first paragraph… nothing to do with me or my post. Not sure who you’re talking to. As for the second and third, there was no problem there since we always had the right paperwork… you see, that was the LAW. Law abiding citizens and all that, you know?… getting more and more unusual what with all these millions of illegals running around. Why am I so hard-hearted? Why are you so quick to ignore laws that you don’t agree with? I disagree with those pesky usury laws – should I ignore them and hope you and others will support my crime? I went through the legal process – one that most of those who are so soppy over illegals have not gone through and it cost me time and money so yes, I resent those who are here illegally making it harder for me to get friends and relatives here legally. What’s so hard to understand? I disagree with giving illegals a pass and I am not a racist just a person who has more real world immigration experience than anyone else posting here.
ForestHillResident says
Ok NewName — So your assertion is that if further illegal immigration is stopped that it’s easier for you to bring your family. I totally agree with the obviousness of your an assertion. Even Anchor Babies agree that it would be easier for their parents to stay with them if there weren’t so many other illegals in this country limiting our ability permit more rightful entries.
My objection is your willingness to infringe on my civil rights as a legal citizen with brown skin and an accent, poor english and a funny last name to get what you want. There is nothing you can point to within the context of the bill that says my rights as a legal citizen won’t be invaded. As a result, I am sorry, but your hardship is not one I choose to care about since you started this by trying to take my rights to leave my house without an ID.
You’re entitled to your opinion. But Don’t Tread on Me.
McDirt — I’m sorry that you attempted to sneak in such a dumb assertion in response to my post that when taken in that context caused us all to wonder aloud if you were a racist. If there is anything I can do to encourage you to stop posting so that it doesn’t happen again, just let me know.
thinking of a new name says
FHR, As a follow up, despite the hysteria, 1070 didn’t check anyone’s ID unless they were stopped for some infringement. I’ll trust our police force that risks their lives every day to protect you and I not to abuse this law… don’t worry though, money grubbing sob’s and their lawyers will find something else to sue about. I have faith.
You needn’t worry about me being fooled into thinking ANY politician of any party is anything more than a lying dirtbag.
thinking of a new name says
FHR, anyone detained for any infringement of the law is required to present ID. If they are legal residents, they must carry a resident alien card AT ALL TIMES. The feds told them that when they gave it to them. No one is infringing on anyone’s civil liberties. That’s a red herring. I already knew you didn’t care about my hardship since I don’t hold viewpoints matching your own. The liberal viewpoint tosses anyone who disagrees under the bus. However, I appreciate your candor in admitting it.

I know any attempt to make you think differently is pointless but it’s important to me that you understand just how big of a joke you really are.
I’ve been making reference to passages appearing on pages 2 and 3 of the seventeen page Arizona immigration bill. It’s unsurprising that a 2 time college drop-out such as yourself was unable to make it through all 17 pages of the bill they’re advocating to bring to Maryland but to not make it past page 1??? How shameful.
The accusation that you wish to rescind the rights of legal citizens come form your July 20th article where you quote the cost of illegal immigration in Maryland as 1.6 Billion referencing studies from the Federation for American Immigration Reform (FAIR). Their website says that more than half the costs are associated with the education of the children of illegal immigrants — most who were born in the US. You and Impallaria have made clear that the rules of law and good conscious must take a back seat to your own ambition but many of us still respect the United States Constitution and it’s definition of citizenship. It’s funny how you seem to know all about it when questioning the birthplace of the president but then conveniently want to ignore it now.
Feel free to keep crying about how impolite I am to you since I do enjoy it greatly and it just gives me more opportunities to reiterate my message — that you need to go.
Since you have no problem with dehumanizing my fellow citizens promising to make every effort to send their parents home and force them into foster care as wards of the state, I see no problem in viewing you in the same regard. The bible (no doubt you never made it all the way through this book either) tells you to treat others as you wish to be treated so consider this your chance to reap what you sow.
So please just save us all the hassle of voting you out and quit now.

Whatever they say next always is bad.
I know there are lots of good conservatives (those farmers whose families have always been here and those who come with the military to APG and love it and decide to stay).
I just want to make sure that the bad apples don’t ultimately ruin the bunch.
I want to live in a community that strives for excellence in everything they do yet celebrates simple living and uncomplicated politics. By their word and deed McDonough and Imparallia simply fail to meet a high enough standard to remain in office.

McDonough states: “The Arizona Law simply duplicates the Federal Immigration Act and provides the state with the authority to enforce its tenets”; state governments do NOT have the right to simply dictate how national laws are going to be enforced. I find it amazing that so many so-called ‘strict constructionists’ would support such initiatives. It shows that the extremest conservatives have no real concern about the constitution; rather they are simply against anything that upsets their notion of ‘red-blooded America’, a view that ultimately makes the wealthy richer, the poor poorer, the environment dirtier, keeps more people uneducated, and makes our future murkier.

ProudDemocrat –
Actually municipal, county and state police forces enforce federal laws all the time. SB1070 in Arizona mirrors existing federal law and is in fact less onerous. If Maryland enacted a law similar to SB1070 it would stop Maryland’s municipalities from being sanctuary cities, make the State less inviting to illegal aliens and it would limit the illegal activities of Casa de Maryland.

By making every US citizen with brown skin, an accent, poor English or a funny last name at risk of being detained indefinitely if they leave their house without proper documentation and fail to use a turn signal when changing lanes. Even if cops don’t think detaining someone is the right approach don’t worry BR/Dirt/McDonough will be there to sue them removing the ability for them to exercise good judgement in the field.
Presuming we continue plans to not increase taxes for more police, lawyers and judges this guarantees increased crime, overwhelmed / under-manned police force, even more overcrowded jails, and a continuous stream of civil-rights violation settlements being paid to legal citizens improperly detained.
But hey — it’s all good because at least our even-more crime-ridden, even-more bankrupt cities won’t be sanctuary city (whatever the hell that derogatory notion BR is white washing with that turn of phrase).

Amazing — so Arizona rushed to pass the anti-illegal immigrant bill was to protect themselves from a Texan???

We don’t need McDonough’s distraction. We need to invest in geography lessons.

So you are trying to conflate a story about a US citizen illegally living in Mexico as a violent drug dealer with Arizona SB1070?
Are you insane?
Did you not watch as a child Sesame Street’s “one of these things is not like the others”?

BulleRocker, I’ve figured it out. FHR is really in favor of cracking down on illegals, so he’s posting these crazy things for the other side to make it look like those who support the lawbreakers are all nuts.
It may be working, but I think he’s going a little too far. It’s starting to look more like a comedy piece. Hey – maybe Tom Myers needs another joke writer!

I find it astounding that so many so-called ‘strict constructionists’ would support such initiative. It shows that the extremest conservative have no real concern about the foundation; rather they are simply against whatever thing that upsets their notion of ‘red-blooded America’, a view that eventually makes the well-heeled richer, the poor poorer, the environment dirtier, keeps more people unqualified, and makes our future murkier.

What kind of people post the exact same comment twice? Probably the same kind of people who capitalize Grunts and Monosyllables.

does Del. Pat McDonough have any constructive things to say? Over the last year or so all I’ve heard from him and Rick I. are political sound bites. If you don’t like how things are, you are free to put foot to pavement and move. Like Arizona , they got plenty of forclosed houses for sale cheap.
